TERMS AND CONDITIONS, PARTICIPATION WAIVER, AND MEDIA RELEASE
Last updated: October 8, 2026
These Terms and Conditions apply to The Yoga Studio LLC (“The Yoga Studio,” “we,” “us,” or “our”), our Broad Ripple and Carmel locations, our website at www.indyyogastudio.com, our mobile application, and our classes, memberships, products, workshops, events, and other services (collectively, the “Services”).
Please read these Terms carefully. They include an assumption of risk, a release of liability, and permission to use photographs and recordings. We require participants to affirmatively accept the participation waiver and media release before participating. Visiting the website alone does not constitute signing the participation waiver.
1. Accounts and eligibility
You agree to provide accurate registration, contact, billing, and emergency contact information and to keep it current. You are responsible for protecting your account credentials and promptly reporting unauthorized account activity.
Adults may register on their own behalf. Minors may participate only in classes approved by the studio, with required parental or legal guardian permission and documentation. A parent or legal guardian must complete the applicable registration and acceptance requirements for a minor. These Terms do not authorize minors to enter payment or membership agreements independently.
2. Classes, reservations, and studio policies
Reservations are subject to capacity and availability. Class times, instructors, formats, and offerings may change. We will make reasonable efforts to communicate material schedule changes and address affected reservations under the applicable purchase terms.
Participants must follow instructor directions, equipment instructions, and studio safety rules. Arrive before the scheduled class start. Studio doors are locked at class start, and late entry may not be available.
Cancellation deadlines, no-show rules, waitlist procedures, and any applicable fees are disclosed in the booking system or applicable purchase agreement. Autopay members are not charged late cancellation fees under our current policy. This does not automatically waive any separately disclosed no-show fee. Changes to this policy will be communicated before taking effect as required by law.
A waitlist reservation does not guarantee a space. Follow the instructions accompanying any waitlist offer or confirmation. Reservations through third-party booking services are also subject to that provider’s applicable terms.
3. Purchases, memberships, and recurring payments
Prices, package inclusions, expiration dates, eligibility restrictions, refund terms, and membership conditions are disclosed before purchase. Review the terms of your selected product or membership before completing payment.
Recurring memberships require separate authorization for recurring charges. Your membership agreement or checkout disclosures identify the amount, billing frequency, renewal terms, any minimum commitment, and how to cancel. These Terms alone do not authorize recurring charges.
Cancellation, freezing, refunds, transfers, and unused credits are governed by the terms disclosed for the specific purchase and applicable law. We do not impose a blanket nonrefundability rule through these Terms. Canceling a class reservation does not cancel a membership. Deleting an app or stopping attendance does not itself cancel recurring billing; follow the cancellation method disclosed in your membership agreement.
Future price changes will be communicated as required by applicable law and your agreement. Changes do not retroactively alter a completed purchase or override an agreed price commitment.
4. Conduct and use of the Services
Treat staff and other participants respectfully. Do not engage in harassment, threats, discrimination, unsafe behavior, or unauthorized recording of others. Do not participate while impaired by alcohol, drugs, or any substance that prevents safe participation.
Do not misuse our website or app, impersonate another person, access another person’s account without permission, introduce malicious software, interfere with security, or collect others’ personal information without authorization.
We may restrict or suspend access for safety concerns, unlawful conduct, or material violations of these Terms, subject to applicable law. Any remaining payment obligations or refunds will be handled under the applicable agreement and law.
5. Privacy and communications
Our Privacy Policy explains how we collect, use, retain, and disclose personal information. It applies alongside these Terms. A liability waiver does not waive privacy rights that cannot lawfully be waived.
We may send service communications concerning reservations, waitlists, schedule changes, payments, and memberships. Promotional emails and texts are subject to applicable consent and opt-out requirements. Accepting these Terms or the media release does not itself constitute consent to promotional text messages.
6. Participation waiver: activities covered
In Sections 6 through 12, “I” and “my” refer to the participant accepting this waiver. The activities covered include yoga; hot and infrared-heated classes; mat and reformer Pilates; sculpt, strength, mobility, and fitness classes; workshops; private sessions; studio events; and live or recorded virtual instruction. The waiver applies at either studio, at other locations where The Yoga Studio conducts activities, and during participation outside the studio using our instruction.
I understand that instruction may include demonstrations, verbal cues, suggested modifications, and hands-on adjustments when I consent. My participation is voluntary, and I may decline a movement or stop participating at any time.
7. Health, readiness, and personal responsibility
I understand that yoga, Pilates, fitness instruction, and other studio activities are not substitutes for medical attention, examination, diagnosis, or treatment. The Yoga Studio and its instructors do not provide medical advice or determine whether an activity is medically appropriate for me.
I am responsible for consulting a qualified healthcare professional before participating, particularly if I am pregnant or postpartum, have an injury or medical condition, take medication that affects exercise or heat tolerance, or have concerns about my ability to participate safely. I will obtain medical clearance when appropriate or required.
I represent that, to the best of my knowledge and with any necessary medical guidance, I can safely participate in the activities I choose. I will not participate in activities that a healthcare professional has advised me to avoid.
I am responsible for communicating relevant limitations or accommodation needs to the instructor, recognizing that disclosure does not guarantee that a class can be made suitable for me. I will work within my abilities, use appropriate modifications, and stop if I experience pain, dizziness, faintness, unusual shortness of breath, overheating, or other concerning symptoms. I will promptly notify an instructor or staff member of an injury or safety concern.
8. Assumption of risk
**I UNDERSTAND THAT PARTICIPATION INVOLVES RISKS OF INJURY, INCLUDING SERIOUS OR DISABLING INJURY AND, IN RARE CASES, DEATH. THESE RISKS CANNOT BE ENTIRELY ELIMINATED.**
Risks include, without limitation:
– Muscle strains, sprains, joint or back injuries, falls, and loss of balance.
– Aggravation of an existing injury or medical condition.
– Dehydration, overheating, heat-related illness, dizziness, fainting, and cardiovascular stress, particularly in heated or infrared-heated classes.
– Injuries involving reformer carriages, springs, straps, ropes, footbars, platforms, weights, bands, balls, and other equipment, including moving parts and pinch points.
– Equipment malfunction, improper use, and mistakes in setup or adjustment.
– Risks associated with physical adjustments, contact with others, and conditions of the premises.
– Exposure to communicable illnesses in shared spaces.
– Additional risks of virtual participation, including an unsuitable environment, lack of direct supervision, inability to receive immediate assistance, and technical interruptions.
I understand that risks may arise from my actions, other participants’ actions, equipment or facility conditions, or the ordinary negligence of The Yoga Studio or the Released Parties defined below. I voluntarily assume these known and unknown risks to the fullest extent permitted by law.
For heated classes, I am responsible for assessing my tolerance for heat, maintaining appropriate hydration, and leaving or stopping when needed. For equipment classes, I will obtain instruction before using unfamiliar equipment, follow setup directions, and report suspected defects rather than continuing to use unsafe equipment.
For virtual or recorded classes, I am responsible for providing a clear, stable exercise area, suitable equipment, and access to assistance if needed. I understand that instructors may be unable to observe me or respond to an emergency.
9. Release of liability and agreement not to sue
“Released Parties” means The Yoga Studio LLC and its owners, members, managers, employees, instructors, independent contractors, agents, and representatives acting in connection with the covered activities.
**TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE THE RELEASED PARTIES FROM CLAIMS, DEMANDS, DAMAGES, AND CAUSES OF ACTION ARISING FROM MY PARTICIPATION IN THE COVERED ACTIVITIES OR MY USE OF STUDIO PREMISES OR EQUIPMENT, INCLUDING CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE CAUSED BY THE ORDINARY NEGLIGENCE OF THE YOGA STUDIO LLC OR ANY OTHER RELEASED PARTY.**
**THIS RELEASE EXPRESSLY INCLUDES THE RELEASED PARTIES’ OWN ORDINARY NEGLIGENCE IN INSTRUCTION, SUPERVISION, PHYSICAL ADJUSTMENTS, EQUIPMENT SETUP OR MAINTENANCE, AND CONDITIONS OF THE PREMISES.**
To the fullest extent permitted by law, I agree not to bring an action against a Released Party for a claim validly released by this waiver. This release does not apply to gross negligence, reckless or intentional misconduct, or any liability or right that cannot lawfully be released. It is intended to bind me and, to the extent permitted by law, my estate, heirs, and personal representatives.
10. Hands-on adjustments, emergencies, and belongings
I understand that an instructor may offer physical assistance or hands-on adjustments. I may decline them or withdraw permission at any time. Acceptance of this waiver is not blanket consent to unwanted physical contact. If I consent to an adjustment, I understand that it may carry a risk of discomfort or injury.
If an emergency occurs, I authorize staff to seek emergency assistance and share information reasonably necessary for my care if I am unable to communicate. This does not require staff to provide medical treatment. I am responsible for my medical and transportation expenses, subject to any rights or remedies available under applicable law.
I am responsible for securing my belongings. To the extent permitted by law, the studio is not responsible for loss, theft, or damage to personal property, subject to the limits of the release above.
11. Photography, video, and media release
**AS PART OF THIS PARTICIPATION AGREEMENT, I AUTHORIZE THE YOGA STUDIO LLC AND THOSE ACTING ON ITS BEHALF TO PHOTOGRAPH, FILM, OR OTHERWISE RECORD ME DURING STUDIO CLASSES, WORKSHOPS, EVENTS, AND RELATED ACTIVITIES, AND TO USE MY LIKENESS, IMAGE, AND VOICE AS DESCRIBED BELOW.**
I grant permission to reproduce, edit, display, publish, and distribute these materials for studio business and promotional purposes, including our website, mobile application, social media, newsletters, print materials, and advertising, in current and future media, without compensation to me.
This permission is nonexclusive, worldwide, and continuing to the extent permitted by law. I understand that materials published online may be copied or redistributed by others. I waive the right to inspect or approve the finished materials or their permitted uses.
To the fullest extent permitted by law, I release claims arising from the authorized use of my likeness, image, or voice, including claims for compensation or infringement of publicity rights. This permission does not authorize filming in restrooms or changing areas, disclosure of confidential health or account information, unlawful use, or a false statement that I personally endorse an unrelated product or business.
This media permission is included in the participation agreement rather than offered as a separate optional election. Any rights of withdrawal or objection required by applicable law remain available. Requests or questions may be sent to info@indyyogastudio.com.
12. Minors and guardian authorization
If I am accepting on behalf of a minor, I represent that I am the minor’s parent or legal guardian and am authorized to give the permissions stated here. I have reviewed the activities and risks, authorize the minor’s approved participation, and will communicate relevant limitations and emergency contact information.
I authorize photography and recording of the minor and the uses described in Section 11, to the extent permitted by law. The assumption of risk and release apply to a minor and the guardian only to the extent legally enforceable. Nothing in this agreement claims that a guardian can waive every legal claim belonging to a minor.
The studio may require a separate guardian form, additional consent, or age-specific participation conditions before a minor attends.
13. Responsibility for harm to others
To the extent permitted by law, you agree to indemnify and hold the Released Parties harmless from third-party claims and reasonable associated expenses caused by your unlawful conduct, intentional misconduct, or material violation of these Terms. This provision does not require you to indemnify a Released Party for that party’s own negligence or misconduct or for claims that cannot lawfully be shifted to you.
14. Website content and third-party services
Our branding, original class materials, photographs, videos, and website content are owned by us or used with permission. You may use them for authorized personal purposes but may not reproduce, sell, distribute, or commercially exploit them without permission.
Booking, payment, shopping, and other functions may be provided through third-party platforms. Their applicable terms and privacy policies may also govern your use. We do not control independently operated third-party websites, but their involvement does not eliminate our own legal obligations.
We make reasonable efforts to keep information accurate and may correct errors. If an error materially affects a completed purchase, we will contact you and provide an appropriate correction or remedy under applicable law. Digital services may experience interruptions; we do not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by law, we disclaim implied warranties concerning website and app functionality and exclude indirect or consequential losses arising from use of those digital services. These limitations do not expand the participation release, excuse gross negligence or intentional misconduct, eliminate promised services or legally required refunds, or limit rights that cannot lawfully be limited.
15. Governing law and agreement terms
These Terms are governed by Indiana law, without displacing any mandatory protections that apply to you under other applicable law. Subject to mandatory jurisdiction requirements, disputes may be brought in a court of competent jurisdiction in Indiana.
These Terms, the Privacy Policy, and the specific membership, purchase, and participation agreements you accept form the applicable agreement for the Services. Specific purchase or membership terms control their subject matter if they conflict with these general Terms. A separately signed participation waiver remains effective according to its terms; these Terms do not silently cancel it.
If any provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision on one occasion does not waive future enforcement. Provisions intended to continue after participation or account closure, including valid releases and permissions, continue according to their terms and applicable law.
16. Changes to these Terms
We may update these Terms and will post the revised version with a new update date. Changes apply prospectively, subject to applicable notice and acceptance requirements. We will obtain renewed affirmative acceptance when needed for material changes to the participation waiver or media release. Posting a revision does not retroactively expand a release already signed or change a membership’s agreed terms without required notice or consent.
